    Conflicts

 

  • Focuses on strategic reputational risk management advice in the conflicts space, including commercial risk, confidentiality, client due diligence, conflicts of interest, reputational issues and sanctions.

 

  • Consultation regarding regulatory and professional practice issues relating to conflicts management, drafting conflicts-related policies and procedures, and assisting senior management in relation to conflicts of interest situations.

 

  • Responsible for implementing, embedding and monitoring compliance and risk practices throughout the enterprise.

 

  • Performs conflict checks and associated client onboarding tasks for the entire enterprise, identifying legal, commercial and contractual conflicts issues.

 

  • Performs research, investigations and provides consultation in relation to various professional responsibility and ethics codes, and global anti-corruption statutes.

 

  • Acts in the capacity of conflicts and client due diligence subject matter expert (SME).

 

  • Performs research and analysis of potential client risks, collects and analyzes client verification due diligence material, compares information on potential clients with information about existing clients to identify potential commercial and legal conflicts, reviews confidential personal information, drafts required documents, such as consents to access personal information and conflicts waivers, makes recommendations regarding data and client isolation if required.

 

  • Provides conflicts training to management and relevant personnel.

 

  • Performs internal and internet database searches using Boolean operators and expressions, for affiliates, related parties and existing engagement information.

 

  • Responsible for running accurate and focused conflicts searches for preliminary information about potential new engagements and clients.

 

  • Maintains and updates the conflicts database on a daily basis.

 

  • Reviews engagement and retention agreements regarding proper compliance and execution.

 

  • Conducts conflict checks on potential new employees.

 

  • Working knowledge of databases and platforms such as Intapp Conflicts, Standard & Poor’s (S&P) Capital IQ and Thomson Reuters Elite.

 

  • Proactively reports to the internal ethics & conflicts committee on complex conflicts questions and other compliance issues.

 

  • Investigates and resolves erroneous, incomplete and outdated data on conflicts reports and ensures that corrections are made the database and on other records, to ensure integrity of information throughout the enterprise.

 

  • Keeps current with best practices and recent research on ethics and conflicts management for all jurisdictions in which the enterprise maintains offices.

  • Research, testing, use, recommendation, specification and procurement of various conflicts management software (CMS) platforms, such as AbacusLaw, Actionstep Conflict Check, Amicus Attorney, Birdeye, Broadly, CaseFox, Client Conflict Check, Cosmolex Client Conflict Check, GoMatters, HoudiniEsq, iManage Conflicts Manager, LawTime, LSS Conflict of Interest, NuLaw, OpenText Conflicts Management, Perfectlaw Conflict Checker, Podium, RTG Conflicts, SILQ Conflict Check, Upfront.
