    Construction (Risk Management)

 

  • Experience with insurance claims, such as first-party insurance claims (for individual insurance directly from an insurer, such as business interruption or commercial property insurance, that may involve bad faith allegations, such as attempting to settle for an unrealistically-low amount, blaming the loss on events other than the actual cause, denying the claim altogether, failing to perform an adequate investigation, intentional misinterpretation of the contract language against the claimant, prolonging the claims process unnecessarily, threatening to drop the claimant’s coverage if they continue the claim, unnecessarily delaying payment of claims, wrongfully claiming your loss is not covered), general claims (between an individual or multiple claimants against one or more insurers, such as for denial or undervaluing a claim), health insurance claims (between an individual and a health insurer), natural disaster claims (generally involving catastrophic property loss by an individual or business due to extreme climate or weather conditions, such as earthquakes, floods, hail, hurricanes, lightning, tornadoes, wildfires, winds) and Workers’ compensation claims (for workplace injuries sustained on the job, such as a concussion or contusion, or the loss of a limb due to operating machinery, or due to mere presence on the job over an extended period of time, such as mesothelioma form unknown exposure to asbestos); familiarity with long-term injuries and next-generation injuries (such as birth defects), caused by daily exposure to hazardous fumes emanating from a nearby plant (such as a concrete plant, chemical plant) or refinery, or contamination of the groundwater, or through various activities (such as asbestos remediation or welding).

  • Developed construction-related corporate policies, records retention policies, insurance and risk mitigation strategies.

 

  • Procurement and management of all construction-related insurance, surety, bonds and risk management.

 

  • Working knowledge of construction-related lines, such as Auto Liability, Builder Risk, General Liability, Employers Liability, Excess, Inland Marine, Professional Liability, Site Pollution, Surplus, Umbrella, Workers’ Compensation.

 

  • Experience with construction-related bonds, such as bid, construction, fidelity, maintenance, payment, performance.

 

  • Legal support for the core disciplines of architecture, engineering and construction, as well as for the various general corporate legal operations, such as service contracts, leases, insurance, development of corporate policies, business registration and compliance.

 

  • Development and implementation of construction-related corporate policies, privacy policies, records retention and management policies, insurance and risk mitigation strategies.

 

  • Management of all construction-related insurance, surety, bonds and risk management structure and compliance.

 

  • Legal review of cover structures, wordings, proposals and quotations.

 

  • Identification of labor-related risks and provided consultation regarding general labor, non-union and union issues.

 

  • Oversight of legal and regulatory compliance affecting corporate operations and risk management activities.

 

  • Ensured that all procedural and bylaws requirements and required governmental filings were accomplished.

 

  • Acts as chief compliance officer by developing policies and procedures for compliance with local, state, and federal laws.

 

  • Conducted and managed investigations of potential compliance or governance issues.

 

  • Conducted and managed internal compliance and legal risk management training, and implemented compliance solutions for the operational groups.

 

  • Actively engaged in all safety initiatives, to ensure as safe and as hazard-free work zones as possible, thus attempting to keep OSHA violations, recordable incidents, Workers’ Compensation claims and tort claims to a minimum.

 

  • Management of various business-related and construction-related insurance policies and risk management structures, and extensive personal interaction with insurance professionals.

 

  • Experience working with binding authority agents.

 

  • Development and implementation of business-related and construction-related corporate policies and procedures.

 

  • Comprehensive knowledge of principles and procedures for commercial law transactions and regulatory compliance.

 

  • Compliance with international codes, such as the International Building Code, International Energy Conservation Code, International Fuel Gas Code, International Fire Code, International Mechanical Code, International Plumbing Code, International Residential Code, International Swimming Pool and Spa Code.

 

  • Spearheaded discussions and negotiations with insurance and reinsurance brokers.
